XPRESS GAS LIMITED DATA PROTECTION AND PRIVACY STATEMENT

1.         Audience

This policy applies to all visitors to our app, web app and customers who have subscribed to the services we offer. Please read this Privacy Notice to understand how we may use your personal data.        

2.         Purpose of this policy

We respect your privacy and take the protection of personal information very seriously. The purpose of this policy is to describe the way we collect, store, use and protect information that can be associated with a specific natural or juristic person and can be used to identify that person (“personal information”).

2.1       Personal information includes:  Information collected on registration and optional information that you voluntarily provide to us.


2.2.       Personal information excludes:  Information that has been made anonymous so that it does not    identify a specific person; permanently de-identified information that does not relate or cannot be traced back to you specifically; non-personal statistical information collected and compiled by us and information that you have provided voluntarily in an open, public environment or forum including (without limitation) any blog, chat room, community, classifieds or discussion board.

3.         Acceptance of terms

By using our App and digital channels, you accept all the terms of this policy when you register for any of our services. Your usage of the App indicates you have legal capacity to conclude legally binding contracts. By accepting this policy, you are deemed to have read, understood, accepted, and agreed to be bound by all its terms.

4.         What Personal Information do we collect and use?    

Upon registration, you authorize us to collect personal information as Registered Data Processor with the Data Protection Commission. In the normal course of our relationship, we expect to collect the following information about you:

  • Details about you: your name, date of birth, postal address, employment status and occupation, and when you plan to retire;
  • Details about your household: your marital status, names and ages of other family members; your current and future plans for the education of the children you are responsible for;
  • Details about your home: the area in which you live and whether you own or rent your home;
  • Details about your financial safety nets: your existing insurance cover and workplace benefits;
  • Details from the services we provide to you: the profile we create about you, recordings of calls with our Customer Service Center, the advice that we give, and the services you may purchase from our partners.
  • If you elect to make payments by credit card/mobile money then, we may also collect credit card/mobile money numbers and other payment information.
  • In order to provide the Services to you, you will be asked to provide us with additional information on a voluntary basis such as (“Service information”).
  • You may also provide additional information on a voluntary basis (“optional information”). This includes content or product that you decide to upload or download from our App or when you enter competitions, take advantage of promotions, respond to surveys, register and subscribe for certain additional services, or otherwise use the optional features and functionality of the App.


5.         What we do with information we gather          

We use your personal data collected through our App for a variety of business purposes. These include, but are not limited to:

  • Verifying your identity;
  • Completing transactions effectively and billing for products and services;
  • Responding to your request for service or assistance;
  • Performing market analysis and research as well as business and operational analysis;
  • Providing, maintaining and improving our products and services;
  • Anticipating and resolving issues and concerns related to our products and services;
  • Promoting and marketing our products and services which may benefit you and be related to products and services you are currently enjoying;
  • Sending you information, including confirmations, invoices, updates, and support and administrative messages
  • Ensuring adherence to legal and regulatory requirements for prevention and detection of fraud and crime.

6.         Cookies.

We use session cookies and these may be used by your browser on subsequent visits to our App. We use information gathered by cookies to improve the App.

7.         Location of Your Personal Data          

Personal data collected by Xpress Gas Limited is stored on secured cloud service and processed in Ghana.         

8.         Sharing of your personal data

  • Except as disclosed in this privacy policy Xpress Gas does not share your personal data with any outside parties.            We share personal data with your consent or as necessary to complete your transactions or provide the services you have requested or authorized.
  • We may share your personal data with outside parties who perform services on our behalf. For example, we may hire other companies to handle the processing of payments, to provide data storage and to conduct audits, etc. Those companies will be permitted to obtain only the personal data they need to provide the service. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose.
  • Xpress Gas maintains contracts with these third parties requiring their treatment (access, use and disclosure) of personal data to be consistent with our obligations under the law.
    We reserve the right to disclose your personal data if we have a good faith understanding we are required to do so by law (including to meet national security or law enforcement requirements), or in the good-faith belief that such action is reasonably necessary to comply with legal process, respond to claims, or protect the rights, property or safety of our company, employees, clients, or the public.

9.         How do our partners use your personal data?

We work with some carefully selected partners who use your personal data to enable us to deliver our services to you, and to meet their own legal and regulatory requirements. In particular, we would draw your attention to the following:

  • We may undertake “soft” checks with a credit reference agency as a means of validating certain personal information about you.
  • We may be asked to provide personal data as part of our regulatory obligations or to process complaints effectively.
  • If you purchase insurance through Xpress Gas, we may supply the insurance provider with your name, address, and contact details as well as other information about your insurance requirements to help them provide you with the insurance you require.
  • You may discover and access Xpress Gas through a third-party site, marketplace or application, such as your bank, into which our service is integrated or supplied through. To improve your use and enjoyment of those other services, you may choose to allow us to share some of your data with that third-party.
  • Our partners may use the personal data you provide for purposes such as fraud prevention or for internal analysis (such as monitoring customer demographics, market trends or pricing analysis).
  • We are not responsible for the privacy policies or practices of our partners (or other websites you may click through to from our App). You should ensure you read and are fully aware of the terms and conditions and the privacy policies of third-party websites.
  • We may also transfer your personal data to generic service providers who control or process personal data on our behalf to enable the efficient technical and logistical provision of our services. These service providers supply us with cloud data storage, data security services, customer relationship management software, and support ticketing services. We may substitute a technical or logistical service provider from time to time. Such parties are generally not permitted to use your personal data for any other purposes than for what your personal data was collected, and we require them to act consistently with applicable laws and this Notice as well as to use appropriate security measures to protect your personal data.

10.        Security of personal information

We protect your personal information using safeguards such as firewalls and data encryption to protect personal information. What data we store, we will protect within commercially acceptable means to prevent loss and theft, as well as unauthorised access, disclosure, copying, use or modification.

We do not share any personally identifying information publicly or with third-parties, except when required to by law. We authorize access to personal information only for those employees who require it to fulfil their job responsibilities.

11.        Retention of personal information

We will only retain your personal information for as long as it is necessary to fulfill the purposes mentioned in clause 5, unless: 

11.1.     Retention of the record is required or authorised by law; or         
11.2.     You have consented to the retention of the record.         
11.3      During the period of retention, we will continue to abide our non –

disclosure obligations and will not share or sell your personal information.

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

12.        Limitation and Enquiries

We are not responsible for, give no warranties, nor make any representations in respect of the privacy policies or practices of any third-party websites or Apps.

13.        Prevention of fraud and financial crime

We may carry out analysis and research using your personal data to prevent or detect fraud or other financial crime.

14.        Business continuity

In the event of an interruption or cessation of our business, we need to ensure that we can implement our business continuity procedures (for example, we may need to rebuild our IT systems), or wind down planning to protect your interests. This may involve the processing of your personal data, including a transfer to an alternative service provider.

15.        Changes to our privacy policy and our contact information   

We reserve the right to change the terms of this privacy policy at any time when necessary to reflect changes in our services, how we process personal data, or applicable law. When we make changes, we will revise the “last updated” date at the end of the policy. If there are material changes to this statement, we will provide notice or obtain consent regarding such changes as may be required by law. 16.        Law

This Data Protection & Privacy Notice is subject to the laws of Ghana and the exclusive jurisdiction of its Courts.
